AI and the law

The use of Artificial Intelligence (AI) within society is increasing at a phenomenal rate. This increased use of AI has been fuelled by the increased availability of data and developments within Machine Learning (ML) techniques using complex mathematical algorithms. The self-learning capability of AI makes it an effective tool who should receive credit, who should receive state benefits, who should be offered a job and what medical diagnosis is optimal. But what exactly is AI and how does it work? And what are the legal implications of the increased use of AI within society? This workshop examines the notion of AI, providing examples of its application in society and discusses current regulatory strategies being used to minimise the risks associated with this technology.

The role of the law in regulating AI is pivotal and not without its own complexities. The law must protect society from this technology while at the same time it diminishes access to this technology, this protection taking the form of Intellectual Property Rights and trade secrets. Complicating matters is the fact that legislating attempting to regulate AI takes the form of a patch-work of regulatory tools, making their application even more complex.

This workshop will illustrate the risks and vulnerabilities associated with AI. It will also review the various regulatory strategies developed to regulate AI, from the ethical code of the High-Level Expert Group on AI, to more concrete legislation such as the General Data Protection Regulation (GDPR), the draft proposal for a Regulation on AI (“AI Act”) and the Medical Devices Regulation. It will provide insight into the deficiencies of current legislation in dealing with AI, highlight challenges in applying traditional legal instruments and provide insights into the skills required by those involved in the application of AI technologies, especially from the legal perspective. Finally, it will provide a strategy for how “non-technical” people should understand this technology and approach it.

• Defining AI
• Examining the technologies comprising AI
• Examining the general application of AI in society
• Examining the potential harms of AI
• Providing specific instances of the use of AI in the courtroom and how this challenges legal notions such as the rule of law
• Providing specific instances where AI was used to detect fraudulent behaviour and how this went wrong
• Examining the legal regulation of AI with specific reference to ethics, the GDPR and the forthcoming AI Act
• The use of practical exercises in accomplishing the above

Kursen ges på engelska då ämnets terminologi mestadels är på engelska, men Stanley pratar svenska så frågor kan ställas på både svenska och engelska under kursdagen.
